Constitutional Amendment 4 proposes replacing ‘sheriff’s sales’ with new method for property tax collection


Louisiana voters will have the opportunity to vote on Constitutional Amendment 4 this Saturday, which will determine how delinquent property taxes are handled in the state. The proposed amendment aims to replace the current ‘sheriff’s sales’ system with a ‘tax lien auction process’, where the government can place a lien on a property if taxes are not paid, then sell the lien to someone who hopes to collect the debt and penalties. Homeowners would have the option to sell the property to pay off the debt or face foreclosure if they do not pay.

The current system of tax sales has faced legal challenges and may be in violation of a recent Supreme Court ruling. A ‘yes’ vote on Amendment 4 would replace the tax sale process, establish an emergency exception for property tax deadlines, and remove property debt language from the constitution to allow for easier changes in the future. A ‘no’ vote would keep the current system in place. Voters are encouraged to learn more about the proposed amendment before heading to the polls this Saturday.
