New York doctor charged for prescribing abortion pill in Louisiana


Dr. Margaret Carpenter, a New York doctor, has been indicted by a Louisiana grand jury for allegedly prescribing an abortion pill online, violating the state’s strict near-total abortion ban. Along with her company Nightingale Medical, PC, and a third person, Carpenter faces charges of criminal abortion by means of abortion-inducing drugs, a felony. This is believed to be the first case of criminal charges against a doctor for sending abortion pills to another state since Roe v. Wade was overturned in 2022.

Louisiana recently reclassified mifepristone and misoprostol as controlled dangerous substances, imposing fines and jail time for illegal possession without a valid prescription. The state’s attorney general, Liz Murrill, has vowed to hold individuals accountable for breaking the law, including pregnant women who obtain the drugs without a prescription.

The indictment could be a test of New York’s shield laws, which protect prescribers who use telehealth to provide abortion pills to patients in states where abortion is banned. New York Governor Kathy Hochul expressed support for these laws, while Attorney General Letitia James, who would enforce them, has not commented on the case.

Pills have become the most common method of abortion in the U.S., leading to political and legal debates. In January, a judge allowed three states to challenge federal government approvals for the prescription of abortion-inducing drugs. The Abortion Coalition of Telemedicine has criticized the prosecution of Carpenter, highlighting the ongoing battle over women’s rights in the post-Roe v. Wade era.
