Louisiana Governor’s Appointment Powers Under Review
In a potential shift in Louisiana’s regulatory landscape, the state’s House of Representatives has passed House Bill 603, which would enable the governor to appoint members to 32 occupational licensing boards without being confined to lists from industry trade associations. These boards oversee diverse professions, including accountants, plumbers, psychologists, and engineers.
Under current law, the governor is mandated to select a certain number of board members from lists provided by relevant trade associations. For instance, appointments to the Louisiana State Board of Examiners of Psychologists must come from the Louisiana Psychological Association’s list. If the bill is signed into law, while associations can still suggest candidates, the governor would not be compelled to choose from these lists.
Rep. Dixon McMakin, the bill’s sponsor, argues that this change is necessary to prevent conflicts of interest and enhance consumer protection. "Allowing associations to dominate their regulatory boards is a direct conflict with the boards’ obligation to protect consumers," he stated.
Opponents, including the Louisiana Association of Substance Abuse Counselors and Trainers (LASACT), voiced concerns that political motivations could undermine thorough vetting processes currently in place for candidate selections. LASACT’s CEO, Marolon Mangham, highlighted the importance of maintaining a non-political framework, particularly for oversight boards like theirs.
Supporters of the bill, such as the Pelican Institute for Public Policy, assert that diversifying board membership can promote entrepreneurship by including more consumer representatives in the regulatory process.
As discussions advance to the Senate, this development reflects broader trends towards consolidating gubernatorial power over state boards, raising questions about the balance between expertise and potential conflicts within regulatory frameworks.
