Trump Requests Supreme Court to Withdraw Legal Status of 500,000 Immigrants

The Trump administration has petitioned the Supreme Court to revoke temporary legal status for over 500,000 immigrants, a program established by the Biden administration. This program allowed 532,000 individuals from countries including Cuba, Haiti, Nicaragua, and Venezuela to reside and work in the U.S. for up to two years. Homeland Security Secretary Kristi Noem is leading the charge to end this initiative.

U.S. District Judge Indira Talwani previously ruled that the administration cannot terminate the legal status of these individuals without conducting individual assessments, effectively blocking the revocation. Solicitor General D. John Sauer criticized Talwani’s decision, arguing it undermined the administration’s immigration policy and contended that federal judges lack the authority to adjudicate on this matter under the Immigration and Nationality Act. Sauer emphasized that Noem possesses extensive discretion regarding immigration determinations and that the law prohibits judicial review of her decisions.

This appeal is part of a broader pattern of cases presented to the Supreme Court by the Trump administration in response to lower court rulings that have blocked its immigration policies. Another relevant case is also pending at the court, which addresses the attempt to revoke temporary protected status for a distinct group of Venezuelans. The outcome of these legal battles could significantly impact the immigration landscape in the U.S., particularly for those protected under temporary legal status.
